If you read my blog in August of this year entitled College Campus Sex Offense Discipline you know that parents of students who are charged with unfounded sexual assault are striking back.
Recently the University Of Pennsylvania was sued by a college student facing expulsion over what he claimed was an unfounded sex assault complaint.
In the suit the plaintiff claims that the sex he had with another student was consensual. His concern that the school could expel him if it concluded that the sex was without consent.
According to federal guidelines the school must only prove that the student is responsible if there is more evidence than not that an assault occurred. It is standard much lower than the beyond the reasonable doubt of a criminal case. Across the country more and more universities are facing law suits based upon their handling of sex assault complaints.
If you are a student or a parent of a student who has been unjustly accused of a sexual assault and gone through the disciplinary process you may have a remedy in the court system.
