Pedestrians Entitled To Use Auto Insurance Coverage

by | Nov 13, 2019 | Car Accidents

Almost everyone knows that if you are a pedestrian struck by a motor vehicle, you can make a claim against the driver’s vehicle insurance. In some cases that driver’s insurance limit may not be adequate to compensate the injured pedestrian.

When there is insufficient insurance for the negligent driver, an injured pedestrian can make a claim against their own motor vehicle insurance. Although it may seem odd that a pedestrian can use his or her own motor vehicle insurance, Pennsylvania allows injured pedestrians to make a claim under their own underinsured portion of the policy. The same goes for the uninsured portion of the pedestrian’s policy if the negligent driver didn’t have any insurance.
